Notice of Termination and Release of Lien

Notice of Termination: A Notice of Termination is a sworn document from the owner of a particular property where construction took place. In some instances it will be the tenant of the property. This document is filed with that particular projectís Countyís Clerk of Courts at the completion of a construction project to cancel The Notice of Commencement. This document is filed to terminate all or a portion of the project or due to new financing for the project. Under the Florida Construction Lien Law, the Notice of Termination is effective to terminate the Notice of Commencement at least 30 days after its recording. Any lienor such as General Contractor or Sub Contractor who is served with a Notice of Termination, and is owed money on the project, should prepare and record a claim of lien prior to the termination date of the Notice of Termination. The original lien will relate back to the recording of the original Notice of Commencement, rather than some later date. It will also be higher in priority from any future lien on the property such as a new mortgage from a new lender.

Release of Lien: A Release of Lien is a written statement that removes your property from the threat of lien. When your construction project is coming to its completion, your contractor will request final payment. You should first request from the contractor, via certified or registered mail, a list of all subcontractors and suppliers who performed labor, or provided services or materials to your property. Make sure that your contractor provides you with an affidavit with final releases from these parties before you make the final payment. If subcontractors or material suppliers were not paid by the contractor, they may go look to your property for payment, even if you have paid your contractor in full. This means that if a lien is filed against your property, your property could be sold against your will to pay for materials, labor, or other services which your contractor may have failed to pay. Always require a release of lien from anyone who does work on your property.
